1. Acceptance of Terms
By downloading, installing, or using the True Palette mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms apply to all visitors, users, and others who access or use the App.
These Terms constitute a legally binding agreement between you and True Palette ("Company," "we," "our," or "us").
2. Description of Service
True Palette is an AI-powered seasonal color analysis tool. The core functionality allows users to capture a selfie using their device camera or select an existing photo from their gallery. Our AI proprietary models then process these images to generate personalized color palettes, skin metrics, and style recommendations.
Note: True Palette does not require account creation or registration to use its features. All analysis results are stored locally on your device or associated temporarily with your device identifier.
3. Eligibility
You must be at least 13 years of age to use the App. If you are between 13 and 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms. We reserve the right to restrict access to the App if we believe these age requirements are not met.
4. Subscriptions and Payments
4.1 Free and Premium Tiers
The App offers basic features for free and advanced analysis features via a premium subscription ("Pro").
4.2 In-App Purchases
All premium features are provided on a subscription basis. All purchases are processed through the Apple App Store. By making a purchase, you agree to Apple's Terms of Service. Payment will be charged to your Apple ID account at the time of purchase confirmation.
4.3 Subscription Renewal
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage and cancel subscriptions in your Apple ID account / App Store settings. We do not issue refunds for partially used subscription periods.
5. License to Use the App
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App on a compatible Apple iOS device solely for your personal, non-commercial use.
You agree not to:
- Copy, modify, or distribute any part of the App
- Reverse engineer or attempt to extract the source code of the App
- Use the App for any unlawful purpose
- Circumvent or attempt to bypass any technological protection measures
6. Your Content and License
When you use the App to analyze photos ("User Content"), you grant us a temporary, limited license to process such content solely for the purpose of providing the color analysis service.
Photos processed for AI analysis are not stored permanently on our servers. You retain all ownership rights to your photos.
7. AI Accuracy Disclaimer
Analysis results are generated by AI algorithms and are provided for informational purposes. Results can be affected by image quality, lighting, and camera settings. We make no guarantees regarding the absolute accuracy of the color seasons or style advice provided.
8. Privacy
Your use of the App is governed by our Privacy Policy. Since we do not require accounts, we do not collect personal identifyable information unless explicitly provided by you (e.g., via support requests).
9. Third-Party Services
This App is made available through the Apple App Store. Your use is also subject to Apple's Standard Licensed Application End User License Agreement.
10. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT THE APP WILL BE CONSTANTLY AVAILABLE OR ERROR-FREE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRUE PALETTE SHALL NOT BE LIABLE FOR ANY INDIRECT OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE APP.
12. Termination
We may suspend your access to the App at any time for violation of these Terms. You may stop using the App and cancel your subscriptions at any time via your device settings.
